1. This Site is a service provided by AXA Financial Limited who have produced or arranged for the production of the information that is available. Throughout these Terms of Use, AXA Financial Limited may be referred to as “we”, “us” or “our”.

3. The information on this Site is provided for information purposes only and none of the information constitutes an offer to contract in relation to a financial service or product.
4. Definitions:
4.1. “AXA Group” means AXA Financial Limited, AXA Life Europe Limited, AXA Isle of Man Services Limited, AXA Isle of Man Limited, AXA Ireland Limited, and any subsidiary thereof, their ultimate holding company and any subsidiary thereof (‘holding company’ and ‘subsidiary’ having the meanings given in section 155 of the Irish Companies Acts 1963, as same may be amended from time to time).
4.2. “Client” means a customer of an Intermediary.
4.3. “Intermediary” means a financial adviser/intermediary, authorised by the Central Bank of Ireland, who uses this website further to a letter of appointment and terms of business issued by AXA Financial Limited.
4.4. “you” and “your” means and refers to the user of this Site, which may be a Client or Intermediary, as the case may be.
Availability
1. We will endeavour to ensure that the Site is accessible for 24 hours a day. However, we will not be liable if, for any reason, the Site is unavailable at any time or for any period.
2. We will not be liable for loss or damage arising in contract, tort or otherwise if the Site becomes unavailable or is suspended for any reason.
Information
1. Full product details are contained in the relevant product guide, key features and policy documentation, copies of which can be obtained via an Intermediary. A decision to invest should not be made on the basis of this website alone. If there is any conflict between the details given on this website and the relevant literature applicable to any contract written by AXA Life Europe Limited or other third party financial product provider then, the product literature and policy documentation will be regarded as the authoritative documents.
2. We do not give investment advice, legal advice or tax advice and Clients are strongly advised to obtain their own professional advice.
3. The information and features of the Site do not constitute any form of advice or recommendation by us and are not intended to be relied upon by users in making (or refraining to make) any specific investment decisions.
4. Information contained on this Site is provided for information purposes only and we will use all reasonable endeavours to ensure that it is accurate at the date of publication. However, because of the nature of the Internet, there may be circumstances in which errors or omissions in the information may occur which are beyond our reasonable control. For example unauthorised access by a third party. We can accept no responsibility in managing the certificate nor can we be held responsible should the security of the digital certificate be compromised.

We accept no responsibility for transactions carried out using your ID and password and/or digital certificate, whether or not the transaction is made by you or someone else using your ID and password and/or digital certificate. You are responsible for protecting and securing your ID and password and/or digital certificate from unauthorised use. If you believe there has been a breach of security you should contact us immediately.
Liability
1. The Site also contains hypertext links to other websites. The responsibility for those sites is that of the parties who are identified as providing those sites and we can accept no responsibility for them or their use.
2. We accept no responsibility for the content of any other site to which a hypertext link to or from this Site exists.
3. We cannot warrant that this Site is free of viruses or technical defects of any description and will not be responsible for any technical problems arising from the use of this Site.
4. We reserve the right to change the content, presentation, user facilities and availability of any part of the Site at our sole discretion.
5. As an Intermediary you agree:
a) to accept responsibility for ensuring that the documents produced for use by Clients and/or us, or any company within the AXA Group are accurate and complete.
b) not to use any hypertext links which exist within the Site and within documents within the Site so as to mislead a Client, us or any company within the AXA Group in any way about the content of the site of the particular document.
c) to indemnify us and the AXA Group for any loss arising as a result of the misuse of any hypertext links.
d) accept responsibility for any damages (including, without limitation, damages for loss of business or loss of profits) arising in contract, tort or otherwise from your inability to use or incorrect use of any material on this Site.
1. We will not pass on your e-mail address to any third party without your permission.
2. Occasionally we will send you e-mails to provide information and keep you up to date with new developments on the Site. If you decide that you do not wish to receive such e-mails we request that you reply with ‘Unsubscribe’ in the subject line to an e-mail you have received. You may change your e-mail address at any time and this can be updated on the Site.

1. The AXA Group or the providers of such information own the copyright and all other intellectual property rights subsisting in the database accessible via the Site and all material on this Site.
2. You are not permitted to download, redistribute or extract any information on this Site in whole or in part other than that information relating directly to your portfolio, or, if you are an Intermediary, to your clients’ portfolios.
3. As an Intermediary you agree:
a) not to use any documents or related graphics appearing on the Site for any reason other than conducting business with any of the companies in the AXA Group.
b) not to modify or amend any documents or related graphics which are available on the Site in any way other than for the purpose of completing the variable permitted within the document, for example the inputting of personal data relating to individual Clients.
c) not to reproduce or store any documents or other information contained on the Site in any manner whatsoever, other than the documents produced as a result of conducting business with any of the companies within the AXA Group or as a result of complying with instruments, orders, regulations and codes (whether or not having the force of Law) which apply to your business.
d) to print the documentation in the form it appears on the Site for the purposes of conducting business with any of the companies within the AXA Group only and not to part print any information or documents, including the accompanying logos, appearing on the Site.
e) not to use any graphics which appear on the Site separately from the accompanying text.
f) that the copyright and any other rights in the material available on the Site are owned by members of the AXA Group.
Applicable Law
1. Irish law shall govern the use of this Site at all times and, in the event of a dispute, the relevant parties shall irrevocably submit to the exclusive jurisdiction of the Irish Courts.
Amendment of Terms of Use
1. We may amend these Terms of Use at any time without prior notice and such amendment shall apply to your use of this Site after such amendment.
Data Protection
1. All personal information you supply to us will be treated in accordance with the Irish Data Protection Acts 1988 and 2003, as same may be replaced, modified or amended from time to time. We will collect and use the information you supply in order to provide the service you require, operate and improve the Site.
2. You will fully indemnify us for any losses, claims, costs or expenses suffered by us or the AXA Group as a result of the breach of this Data Protection and Privacy Statement.
3. It is quite likely that you will use of some of the hypertext links to other sites that are set out in this Site. Some of those sites may be restricted and require the completion of further information by you. You are responsible for the accuracy of your personal information.

Neither we nor any company within the AXA Group shall be liable for any damages resulting from the misuse of personal data supplied by the Intermediary or the Client on the Internet. If you are in any doubt, you should not input any data.
